Judge Tosses Suit Against McD’s

The U.S. District judge in New York, Robert Sweet threw out a suit against McDonald’s alleging it used deceptive advertising, reports The Chicago Tribune.


McDonald’s was pleased with the decision and said it was time to for those seeking a solution to the obesity epidemic facing the nation to recognize “the courtroom is not the appropriate forum to address this important issue.”


A proponent of finding a solution through the courts, George Washington University Law School professor John Banzhaf said it was not time to throw in the legal towel, even after this ruling.


“It took us 30 years to get a smoking case to court and over 700 dismissals,” he said. “There are still many theories that have not been tested. We’ve already had several successes in the area of fat.”
