Judge Tosses Out McDonald’s Suit

Judge Robert Sweet of the Federal District Court in New York dismissed a lawsuit that sought to hold McDonald’s liable for making teenagers overweight.


The suit was tossed-out before reaching the trial stage. Judge Sweet said,”If a person knows or should know that eating copious orders of supersized McDonald’s products is unhealthy and may result in weight gain, it is not the place of the law to protect them from their own excesses.”


Moderator’s Comment: Did the court make the correct
decision in this case?


As the judge said, “Nobody is forced to eat at McDonald’s.”
It is unfortunate that the common sense demonstrated by the court in this case
could not be extended to other suits where individuals seek compensation for
their failures to regulate their own behavior.
